| Abstract: | Розглянуто проблеми типізації слідчих ситуацій в теорії криміналістики. Запропоновано авторський варіант формування типових слідчих ситуацій в методиці розслідування перевищення влади або службових повноважень співробітниками правоохоронних органів. розроблено програми дій слідчого щодо їх вирішення. Рассмотрены проблемы типизации следственных ситуаций в теории криминалистики. Предложен авторский вариант формирования типовых следственных ситуаций в методике расследования превышения власти или служебных полномочий сотрудниками правоохранительных органов. Разработаны программы действий следователя по их решению. |
| Description: | The articles deals with the issues of typization of investigation situations in the theory of criminalistics, analyzes various perspectives on this problem presented by researchers in criminalistics, suggests ideas on the criteria for investigation situation typization, defines conceptual approaches to their ordering. Based on the analysis of modern publications, generalized materials of court and investigation practice and with the use of situational modeling principle the author suggests his own variant of forming generic investigation situations in the methods of investigating into abuse of authority or office by law enforcement officers. The article explains the specific nature of modeled situation, shows its role in organizing and planning the investigation into the category of crimes in question. With respect to every generic situation there have been developed the investigator’s action programs comprising a system of investigation (search) actions to verify the suggested investigation hypotheses and solve the tasks in the pre-trial investigation. The suggested programs are provided as guidelines for investigators to optimize their practical activity. |
