Abstract: Розглянуто актуальні питання, пов’язані з правовим регулюванням організації роботи народних депутатів у тимчасових комісіях Верховної Ради України, проаналізовано чинне законодавство, що регулює таку форму діяльності парламентарів, запропоновані шляхи вирішення деяких проблемних питань, пов’язаних з участю народних депутатів у діяльності тимчасових комісій.
Рассмотрены актуальные вопросы, связанные с правовым регулированием организации роботы народных депутатов во временных комиссиях Верховной Рады Украины, проанализировано действующее законодательство, регулирующее такую форму деятельности парламентариев, предложены пути решения ряда проблемных вопросов, связанных с участием народных депутатов в деятельности временных комиссий.
Description: The purpose of the article is to research into organization of people’s deputies’ work in the parliament. A detailed analysis of numerous forms of a people’s deputy’s activity carried out by the author enables assertion to be made that one of the difficult and legislatively unregulated form of a people’s deputy’s work is participation of people’s representatives in activity of interim investigating commissions and interim special commissions of the Verkhovna Rada of Ukraine. Systematic researches into the problem of activity of interim investigating commissions and interim special commissions in Ukraine provided unambiguous evaluation and confirmed the ineffectiveness of people’s deputies’ participation in the bodies of the parliament in question on the whole. In this connection in the article the legislation of Ukraine dealing with activity of a people’s deputy of Ukraine in interim investigating commissions and interim special commissions of the Verkhovna Rada of Ukraine was analyzed, the state of the problems related to such participation was investigated, and possible ways of dealing with them were proposed. It is stated in the article that the participation of people’s deputies in activity of interim investigating commissions and interim special commissions is one of the forms of parliamentary control. The possibility of a detailed qualified investigation of cases, as well as ensuring of deputies’ involvement in parliamentary process and supplementary opportunity to fulfill their obligations to constituency are among the advantages of this mean of control. In the paper the comparative analysis of the provisions of the Constitution of Ukraine and the sections of the «Law of Ukraine on the Status of a People’s Deputy of Ukraine», which regulate activity of people’s deputies in the parliament namely in the work of interim investigating and special commissions, was done. The analysis suggests that the list of rights of a member of interim investigating or special commission of the Verkhovna Rada of Ukraine will be incapable of ensuring effective work of the bodies in question. The results of this work are the following: firstly, activity of a people’s deputy in interim investigating and special commissions of the Verkhovna Rada of Ukraine remains unregulated by the legislation in force. Secondly, providing for the powers of a people’s deputy as a member of the respective bodies in the «Law of Ukraine on the Status of a People’s Deputy of Ukraine» precludes ensuring of full effectiveness of existence of such commissions. Thirdly, authorization, under a special law, of a member of interim commissions to take explanations from officials and employees of public and local government authorities, managers of enterprises, establishments, and organizations will enable to improve greatly the quality of work both of a deputy himself and of interim commissions in general.
