| dc.description | The article analyzes the function of the state as a manifestation of the character, which are embodied in the immanent aspects of its social impact. Highlighted elements of the methodology of their knowledge – ontological, praxeology, axiological, teleological. It is shown that these elements are related dialectically. Delineate the spheres and objects of state functions. Autonomous spheres of society and demonstrate the essence of the state indirectly (for example, the economic sphere of society is stored as a function object, but not the function itself). State functions translate its essence and embody it in a way to impact on areas of society. In each field appears somewhat of state functions, and each function can be implemented in a number of areas. Sphere of society determines the function of the state, and function objects (public relations) form the emergence of new functions. The functions of the state – a system of complex areas of its substantial activities that are carried out in legal forms and the definition mined dynamics and the combination of private and public interests at different stages of the historical development of the state and society. Analyzes the understanding of globalization in political science and law, and its polysemy estimate. Strengthening mutual dependence of states has made to the development of their positive effects and negative pressure. Economic, political, informational, technological and ideological integration, migration and communication makes difficulties for the interests of the states and give rise to international terrorism and extremism, local wars and conflicts, proliferation of weapons of mass destruction and the growth of international criminality. Increased threats to environmental and food security, conflicts among national cultures. There is a trend of weakening of the nation state, the destruction of traditional political relations under the pressure of new transnational actors authorities. Nation-states are losing much of their traditional functions under the influence of globalization. Among them – the internationalization of the economy, the financial system, cultural and political space. Depending on the nature of their impact on the differentiated functions of the state – anti-globalization state functions and neutral. The functions to counter the negative effects of globalization include: ensuring national economic security, improve the quality of human capital, the formation of positive image of the state. To the neutral state functions include establishing a legal basis for the functioning of the economy, a policy of macroeconomic stabilization, the impact on the allocation of resources and activities of the state in the distribution of income. Updating the state functions associated with innovations in structuring the legal system, the emergence of new institutions and sectors that are caused by the processes of globalization. Features of ensuring the right to the modern needs of development and modification of state functions allow you to see the structure of the legal system of the three branches of the law of the new global generation: 1) the traditional industries (environmental, information, humanitarian law); 2) integrated integrated branches of law that are formed: the right to peace and security, migration law, the right to sustainable development; 3) the branch that have a general outline of its development (economic law – set to contradict the economic crisis; social law). | en_US |

Розмежовуються сфери та об’єкти функцій держави, які визначають їх різноманіття, організацію, змістовні зміни та оновлення, появу нових функцій в умовах глобалізації – інформаційної, міграційної, демографічної, функції сталого розвитку. Разграничиваются сферы и объекты функций государства, определяющие их многообразие, организацию, изменения, обновление и появление обусловленных глобализацией новых функций – информационной, миграционной, демографической, функции устойчивого развития.
