| Abstract: | Проаналізовано еволюцію формування правового статусу закладів охорони здоров'я в Основах законодавства України про охорону здоров'я, у тому числі в окремих підзаконних актах та інших нормативно-правових актах. Виявлено розбіжності між Основами і наказами МОЗ України в переліках закладів охорони здоров'я та умовах ліцензування обігу лікарських засобів. Обґрунтовано необхідність узгодження норм Основ з реальним станом справ, зокрема в частині визначення поняття «заклад охорони здоров'я». Оцінено можливі ризики виникнення колізій щодо правового статусу закладів охорони здоров'я. |
| Description: | The evolution of the legal status of the health care facilities as it is foreseen bу the Principles of Ukrainian Health Care Legislation including certain by-laws and other legal acts was analyzed. Certain cases when orders of the Ministry of Health do not meet the requirements of the Principles in terms of the list of health care facilities and conditions of licensing of medical drugs circulation. The necessity to bring the norms of the Principles to the actual state of affairs was proved and in particular the definition of the term «health care facility». Possible risks of conflicts of laws of the legal status of the health care facilities were evaluated. In the initial wording of the Principles the list and features of the commercial subjects, which provide for the health care, which was foreseen in article 16 of the Principles and article 17 of this legal act highlighted the conditions of carrying out commercial activity in the sphere of health care. Hence, according to the Principles health care was provided bу sanitary and prophylactic, medical and prophylactic, sports and health, sanatorium resort, pharmacy, scientific and medical and other health care facilities. |
