Abstract: The article is devoted to research of the constitutional and legal rules which include common legal principles that are fundamental for the qualification of crimes (the rule of law, the principle of legality, equality of all citizens before the law, the principle of non bis in idem, the principle of humanism, etc.). It is proved that the implementation of these constitutional provisions both in law and in enforcement levels ensure accuracy, stability, sustainability, unanimity, completeness and personality of the qualification of crimes.
