| Abstract: | Досліджено сутнісні характеристики суспільної правосвідомості в Україні. Проаналізовано особливості впливу суспільної правосвідомості на державотворчий процес. Визначено прояви правового нігілізму у вітчизняному державотворенні. Обґрунтовано корелятивність демократизації суспільної правосвідомості та якісних характеристик державотворчого процесу в Україні. Исследованы сущностные характеристики общественного правосознания в Украине. Проанализированы особенности влияния общественного правосознания на процесс государственного строительства. Определены проявления правового нигилизма в отечественном государственном строительстве. Обоснованна коррелятивность демократизации общественного правосознания и качественных характеристик государственного строительства в Украине. |
| Description: | Studied the essential characteristics of public legal awareness in Ukraine. Analyzed features of the impact of public sense of justice on the state-building process. Indicated that a permanent impact on the state-building quality of regulatory support make the degree of development of institutional forms of social consciousness, which is particularly reflected in the quality of legislation adopted in a particular state. It is alleged that social strains of justice find their expression in a variety of state-building subjects – authorities, officials, political parties, and political leaders. Curvature of justice is found in the degree to implementation the aforementioned subjects of law, their attitude to the job duties, understanding their role in the democratic transformations and so on. Determined manifestation of legal nihilism in the domestic state building. At the same time, deformation of public sense of justice gradually overcome influenced by the overall democratization of social relations, through increased development of civil society and their activity. It should be noted that civil society advocates some founder of law, serves as the control of officials. Grounded the correlativity of democratization of social justice and quality characteristics of state building process in Ukraine. The state should create a legal framework for democratic development of justice in Ukraine in order to overcome the vestiges of paternalistic justice. Paternalistic policy of the state that holds society in underdeveloped, immature status on the principle "we – your parents, you – our children" must give way partnership between citizens and authorities. One of the indicators of development of democratic social justice, which affects the state building, is the understanding of freedom, the ability to use it. During the formation of an independent Ukrainian state people got freedom, but unfortunately did not learn how to use it fully, defend and exercise their constitutional rights. Defining features of Ukrainians justice influence on the state-building processes must take into account the constant national character of our people, namely its feature as individualism. Emphasized that individualism can play both positive and negative role in the context of modern Ukrainian society of justice and statehood. |
