Короткий огляд (реферат): Стаття присвячена аналізу завдань й повноважень Вищої ради юстиції та Вищої кваліфікаційної комісії суддів України в світлі узгодження українського законодавства до міжнародно-правових стандартів. Обґрунтовується необхідність розмежування повноважень вказаних органів у сфері притягнення суддів до дисциплінарної та інших видів відповідальності, а також забезпечення їх незалежності при виконанні визначених законом повноважень.
Статья посвящена анализу заданий и полномочий Высшего совета юстиции и Высшей квалификационной комиссии судей Украины в аспекте согласования украинского законодательства с международно-правовыми стандартами. Обосновывается необходимость разграничения полномочий указанных органов в сфере привлечения судей к дисциплинарной и иным видам ответственности, а также обеспечения их независимости при выполнении законных полномочий.
Опис: The author analyzes the tasks and powers of judicial agencies that are empowered to bring judges under responsibility in the aspect of harmonization of Ukrainian legislation with international legal standards. Those agencies are the High Council of Justice (the HCJ) and the High Qualification Commission of Judges of Ukraine (the Commission). According to the article 91 of the Law of Ukraine "On Judiciary and Status of Judges" the Commission takes the decision to remove a judge from his office in the course of criminal proceedings against him and conducts disciplinary proceedings against judges of local and appellate courts. The Commission also submits motions to the HCJ to dismiss judges in cases of illegal conduct by them (article 87 of the said Law). The HCJ according to the articles 3 and 32 of the Law of Ukraine "On the High Council of Justice" conducts disciplinary proceedings against judges of the Supreme Court of Ukraine and Higher Specialized. The Council submits motions to discharge judges to the President or Verhovna Rada of Ukraine (in cases of violation of judicial oath and sentencing a judge for conducting a crime). In most of European countries, there is an independent judicial agency, which plays an exceptional role in career building of judges. The names of these agencies may vary, but they play similar functions. According to the European standards, judges, which had been selected by their colleagues, must compose majority in such agencies. In Ukraine, composition of the HCJ does not meet this requirement. It is necessary to provide such a mechanism of the HCJ formation, which would ensure full institutional independence of this agency. Obviously, this will require revision of the Council's powers, and amendment of the current Constitution of Ukraine. According to the Project of Constitution's Amendment, the HCJ would consist of twenty members. Congress of Judges of Ukraine would appoint twelve members from among the judges to the HCJ. Congress of Advocates of Ukraine, the Congress of Representatives of Higher Legal Educational Establishments and Scientific Institutions would appoint two members to the HCJ. The composition of the HCJ would include ex-officio the Chairman of the Constitutional Court of Ukraine, the Chairman of the Supreme Court of Ukraine, the Chairman of the Council of Judges of Ukraine, the Prosecutor General of Ukraine. The Prosecutor General of Ukraine would not take part in the voting when taking decisions regarding judges. This rule would enhance judicial independence. The author proves the necessity of separation of powers of these agencies in the area of judicial discipline. It is also important to ensure institutional independence of the High Council of Justice and the High Qualification Commission of Judges of Ukraine. Thus, legislation that forbid initiation of the procedure of unfounded dismissal of a judge must be accepted. Judges should not be dismissed for the content of the decisions that they take.
