dc.description	The urgency of a subject of research is caused by distribution of practice of release of persons from criminal liability and need of studying of a role of the prosecutor for practical realization of institute of release from criminal liability. The purpose of this scientific article is theoretical research of problems of participation of the prosecutor in criminal proceedings with release of the person from criminal liability according to provisions of the Criminal procedural code of Ukraine and taking into account practice of its application. The algorithm of participation of the prosecutor in criminal proceedings with release of the person from criminal liability is such: 1) creation of preconditions for involvement of the person to criminal liability by the message to the person about suspicion in commission of a criminal offense; 2) establishment of preconditions for release of the person from criminal liability; 3) ensuring the rights and legitimate interests of the suspect and the victim at permission of a question of release of the person from criminal liability; 4) initiation before court of consideration of a question of release of the person from criminal liability. On the basis of stated the author comes to a conclusion that the role of the prosecutor in criminal proceedings with release of the person from criminal liability is defined by assignment on the prosecutor of powers on criminal prosecution of a criminal offense of the person guilty of commission within which the prosecutor chooses connected with mitigation of repressiveness of criminal proceedings and need of procedural economy of alternative to the general order of criminal proceedings. In this regard, at a stage of pre-judicial investigation the prosecutor is allocated with exclusive competence concerning initiation before court of consideration of a question of release of the person from criminal liability, and power of the prosecutor and court in the considered sphere are interdependent.	en
